Terms of Service

1. Who we are

PromptStudio (the "Service") is operated by promtee ("we", "us", "our"). By using the Service you enter into an agreement with promtee.

2. Acceptance

By accessing or continuing to use the Service you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind it.

3. The Service

PromptStudio is an AI-assisted prompt builder that helps users compose text and image prompts and, where applicable, generate AI outputs through third-party model providers.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.

5. Acceptable use

You must not:

  • use the Service unlawfully or to infringe others' rights;
  • submit prompts intended to generate illegal content, sexual content involving minors, targeted harassment, hate speech, malware, or content designed to deceive or defraud;
  • attempt to jailbreak, reverse engineer, or circumvent safety or technical limits;
  • scrape, probe, or interfere with the security or integrity of the Service;
  • resell or redistribute access to the Service.

6. AI outputs and your responsibility

You are responsible for your prompts, for how you use any output, for verifying its accuracy, and for having the rights necessary to submit any input content. AI outputs may be inaccurate or incomplete and are not a substitute for professional advice (legal, medical, financial, or otherwise). We may filter, refuse, or moderate outputs and may suspend accounts that violate these Terms.

7. Intellectual property

The Service, including its software, design, and branding, is owned by promtee and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. If you believe content on the Service infringes your rights, contact us and we will review and, where appropriate, remove it; repeated infringers may be terminated.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. See also our refund policy.

9. Service level

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that outputs will meet your requirements. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time.

11. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability where it cannot be excluded by law.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which promtee is established, without regard to its conflict of law provisions.
